New York cannabis regulation history
New York’s cannabis journey began in 2014 with the Compassionate Care Act, legalizing medical cannabis. In 2021, the Marijuana Regulation and Tax Act (MRTA) legalized recreational marijuana, setting the stage for a robust adult-use cannabis market.
The rollout has faced challenges, including unlicensed dispensaries and regulatory uncertainty — and for much of 2024 and early 2025, the state had planned to adopt the BioTrack system for seed-to-sale tracking.
However, in September 2025, the Office of Cannabis Management (OCM) announced that New York will transition to the Metrc Seed-to-Sale (STS) system instead of BioTrack, with implementation expected in early 2026.
In the meantime, all licensees are still required to maintain a real-time electronic inventory tracking system to remain compliant.
