New Mexico has been at the forefront of cannabis legislation. In 1978, it became the first state to allow medical cannabis use under the Controlled Substances Therapeutic Research Act, permitting cannabis for select cancer patients as part of a research program.

In 2007, the state formally legalized medical marijuana with the Lynn and Erin Compassionate Use Act.

Significantly, on April 1, 2022, New Mexico legalized recreational cannabis for adults aged 21 and over under the Cannabis Regulation Act, marking a new era for the state's cannabis industry.

Once the license is granted, businesses are responsible for annual fees, including $30,000 for a producer/dispensary license if they’re growing 150 plants or fewer. For each 50 plants, it’s an additional $10,000 per year.
